TERMS & CONDITIONS OF HIRE
HIRE AGREEMENT 1. The hirer agrees to details as described in the
hire agreement and becomes liable for: 2. The hirer agrees to be aware of the Terms and Conditions of Agreement for hire of a camper unit. 3. The hirer acknowledges all particulars contained within this document and that they are correct in every detail, there is no misleading or misrepresentation in any way including, without limitation, by omission. 4. The hirer accepts all liability for any breach of this agreement committed by hirer and/or servants/agents. 5. The Terms & Conditions contained embody the entire agreement between ASWS Camper Trailer and the Hirer, no variation to the hire agreement will bind the ASWS Camper Trailer unless the variation is acknowledged in writing by ASWS Camper Trailer and/or agent. HIRE BOOKING & PERIOD 6. The minimum hire period for any camper is 3 days. 7. School holidays and public holiday long weekends attract a minimum hire period of 1 week. 8. Confirmation of hire is made when the hirer provides the full Deposit/Bond by way of cleared cheque, postal order or cash. A letter of confirmation will be provided to the hirer on receipt of the Deposit/Bond. 9. ASWS Camper Trailer will make every effort to accommodate hirers in the collection and return of camper trailers. 10. The Hirer is to notify ASWS Camper Trailer that the camper trailer is to be returned later than the hire period indicated on hire documentation, the normal late return fee will be the normal daily hire rate (non discounted). 11. Should the camper trailer be returned late due to the failure of the camper trailer during the hire period, the late return fee may be waived provided the hirer has notified ACT-A immediately and evidence of failure is provided. HIRE PAYMENT 12. All Deposit/Bond and Hire Fees are to be paid in full prior to commencement of hire. 13. The Deposit/Bond less any costs identified during cleaning and inspection will be returned to the Hirer within 7 business days of the return of the camper trailer. HIRE CANCELLATION 14. Cancellations of hire made within 21-14 days of booking will be entitled to a 50% refund of the deposit/bond hire confirmation fee. Cancellations made after 14 days of booking will forfeit the deposit/bond in full. HIRE INSURANCE 15A. All camper trailers owned and operated by ASWS Camper Trailer are fully comprehensively insured ( Insurance covers dont cover theft by hirer) 15B. If the hirer damages the trailer while reversing or reverses into another vehicle or object then this will not be covered ASWS Camper trailer insurance and falls back on to the hirer to cover costs or there insurnce company. 16. The Hirer is responsible for all damage to the camper trailer identified as outside of fair wear and tear. 17. An insurance excess of $2,000 is applicable to all hires where damage resulting from an accident (either multiple or single vehicle) or theft occurs during the period of hire, whether insurance is listed as a separate item or included within the standard rates. 18. Where damage to the camper trailer is of a value
up to or less than $2000, the hirer is responsible for payment of repairs:
19. The deposit/bond monies paid do not apply to the above insurance clause and do not form part of any excess payments. 20. Where damage is identified to be of a greater value than the paid Deposit/Bond, ASWS Camper Trailer will reserve the right to collect from the hirer the balance of payment up to the $2000 excess. 21. The Hirer is liable for any collection costs incurred as a result of clause 20 above. The Hirer becomes responsible for payment of these collection costs that are over and above what is owed to ASWS Camper Trailer from the preceding clauses. 22. In the event of accidental damage to a camper trailer and the hirer elects to leave the unit "in situ" and not return the camper trailer to the place of hire or repair where the hirer could have reasonably done so then ASWS Camper Trailer will suffer no claim from the hirer for re-imbursement for accommodation, fees, loss of deposits or any extra and sundry costs involved due to the failure of one of our campers, either through accidental damage, mechanical breakdown or such similar event during the period of hire. 23. The Hirer is liable for all retrieval costs incurred through the non-return of the hired camper trailer to the place of hire as listed in the hire invoice and documentation by the due date unless alternative arrangements have been agreed to. CAMPER TRAILER USE 24. The hirer agrees to provide evidence of a current
drivers licence at time of collecting a camper unit. 25. The hirer agrees not to tow or allow others to tow the Camper Trailer whilst under the influence of alcohol or drugs. 26. The hirer agrees to ASWS Camper Trailer providing details contained within the Hire Agreement to the Police and to receiving information from Police regarding the hirer including destination during hire period. 27. The hirer agrees that any and all traffic infringements, parking fines and any legal costs incurred during the period of hire are at the hirer's expense. 28. The hirer agrees that the Camper Trailer will not be used at any time for any illegal activities. 29. The hirer agrees that the vehicle to be used to
tow the Camper Trailer is: CAMPER TRAILER UNIT 30. The hirer agrees to read and familiarise themselves with the Camper Instructions as provided. The hirer should follow any or all specific instructions as provided by ASWS Camper Trailer or agent at time of inspection or collection of the camper trailer prior to the hire. 31. The Camper Trailer unit is provided fit for purpose
being: 32. ASWS Camper Trailer does not warrant the fitness of the Camper Trailer to perform any particular function or task. 33. The Camper Trailer must not be used to move excessive, inflammable, corrosive or explosive loads/materials which may breach conditions of camper trailer registration or insurance. 34. No materials are to be secured to the roof of the Camper Trailer unless solely contained to the fitted roof racks. Any damage caused to the roof panelling including creasing, denting or scratching will be repaired at the expense of the hirer. 35. No modification to the Camper Trailer is to occur without the express permission of ASWS Camper Trailer or agent. Any replacement parts or equipment are to be to the same or higher standard as originally provided. 36. The Camper Trailer, ancillary equipment and any provided accessories are to be returned in a clean condition and in good order as when collected for hire taking fair wear and tear into consideration. Any loss/es shall be replaced by parts or equipment to the same brand and/or standard or paid for by the hirer. 37. The hirer will pay costs associated with cleaning ($55 per hour) of trailer and/or canvas that is considered to be excessively dirty or heavily soiled. The hirer may alternatively pay a fee for ASWS Camper Trailer or agent to undertake cleaning. A cleaning fee of $75 shall be payable at time of hire payment if this option is to be exercised.(conditions Apply eg. the trailer still has to be returned free from heavy dirt ,dust & mud ect.or extra fees will be charged.) TYRES 39. In the event of tyre becoming unsafe for further use for whatever reason, ASWS Camper Trailer or agent needs to be notified before any purchases are made en-route and receipts need to be supplied otherwise re-imbursement may be denied. This clause applies to a tyre failing under normal operating conditions as expected for the tyre type. 40. The Hirer assumes full responsibility for tyre failure due to staking, damage to tread or sidewall where placed under adverse conditions or situations and hirer continues towing (whether aware or not of damage) and then causes irreparable damage to tyre/s. 41. Where an unserviceable tyre is not returned to ASWS Camper Trailer or proof of such damage provided then it will be deemed that the hirer is at fault and becomes fully liable for replacement cost of tyre with fair wear and tear allowed for; this being determined by ASWS Camper Trailer or authorised agent or representative. 42. Replacement tyres are to be of the same size and ply rating as was originally fitted to trailer upon pick up. REPAIRS 44. The Hirer agrees to pay ASWS Camper Trailer for costs of damage that are in excess of the Deposit/Bond monies already paid, plus costs of any fees incurred by way of process to recover these monies. 45. The Hirer agrees to pay for costs of repair to
the camper trailer and its components and equipment not considered as
fair wear including but not restricted to: CAMPER TRAILER SECURITY 47. In the event of theft ASWS Camper Trailer is under no obligation to provide a replacement camper trailer. 48. The Hirer agrees not to leave or place the hired camper trailer in a situation where it would be susceptible to damage or loss from: 1) Natural disasters eg, fire, flooding, earthquake
or severe storm activity where prior knowledge of such activity is common
place and/or warnings had been officially issued. 49. ASWS Camper Trailer will provide a camper trailer as agreed or a unit of same or similar qualities should one not be available at time of hire. 50. ASWS Camper Trailer will suffer no claim from the hirer for re-imbursement or compensation relating to the use of charged accessories whether this is due to misuse or abusive treatment or non-performance of the accessories whilst on hire. HIRER COMPLIANCE 52. Failure to comply with any or all of the clauses
contained within the Terms and Conditions document may void all insurance
claims and the Hirer agrees to become responsible for all costs incurred
by ASWS Camper Trailer or agent for repairs and recovery of the hired
camper trailer and equipment and any costs incurred by way of legal process
for recovery of same. |
